Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Whisper Media platform (“Service”) operated by Whisper Media (“we”, “us”, or “our”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Whisper Media is a financial intelligence platform that aggregates, analyses, and presents publicly available news and social media content using AI-powered scoring. The Service is provided for informational and research purposes only and does not constitute financial advice, investment recommendations, or solicitations to buy, sell, or hold any security or asset. See Section 8 for the full financial disclaimer.
2. Beta Status and Service Availability
Whisper Media is currently in beta. By using the Service you acknowledge and accept all of the following:
- Features may be incomplete, unstable, or unavailable. Certain features advertised or visible in the interface are in active development and may not yet function as described, may be disabled without notice, or may be removed entirely.
- Specifically, the following features are not yet fully operationalat the time of this update: X/Twitter account tracking (requires a paid third-party API not yet activated), SMS alerts, and certain AI Workflow action types. These are marked “Coming soon” in the interface.
- Service availability is not guaranteed. The platform depends on third-party infrastructure (Supabase, Vercel, Railway, Stripe, Anthropic, Resend) and external data sources. We do not guarantee uptime, data freshness, or uninterrupted access. Outages, degraded performance, or data gaps may occur without prior notice.
- Data may be delayed, incomplete, or inaccurate. Signal scraping runs on scheduled cycles. There may be gaps in coverage due to scraper failures, third-party API rate limits, or infrastructure incidents.
- We may modify or discontinue any feature at any time, including paid features, without liability. If a paid feature is permanently discontinued, we will notify affected subscribers and offer a pro-rated credit or refund.
- Beta participants accept elevated risk. You agree not to rely on beta features for time-sensitive or financially significant decisions.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service you represent that you meet these requirements. The Service is not intended for use by regulated financial professionals in jurisdictions where such use would require additional licensing.
4. Account Registration
- You must provide accurate and complete information when registering.
- You are responsible for maintaining the confidentiality of your credentials.
- You must notify us immediately of any unauthorised access to your account.
- One account per person. You may not share accounts or credentials.
- We reserve the right to suspend or delete accounts that we believe are being used in violation of these Terms, fraudulently, or for market manipulation.
5. Subscription Plans and Billing
- Free tier (Pulse) access is provided at no cost with limited features.
- Paid plans (Insight at $29/mo, Pro at $69/mo) are billed monthly as selected at checkout.
- Payments are processed by Stripe. By subscribing you agree to Stripe’s terms of service. We do not store payment card details on our servers.
- Subscriptions auto-renew on the same date each month. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
- Price changes:We will give you at least 30 days’ notice of any price change via email. Continued use after the effective date constitutes acceptance.
- Failed payments: If a payment fails, access may be downgraded to the free tier. We will attempt to notify you via email before any access change.
6. Refund and Satisfaction Policy
We want you to be confident in your subscription. Our satisfaction policy is as follows:
- 30-day satisfaction guarantee for first-time paid subscribers. If you are not satisfied, contact us at contact@whispermedia.ai within 30 calendar days of your firstpaid charge with subject line “Refund Request”.
- Processing time:Approved refunds are processed within 5–10 business days. Depending on your card issuer or bank, funds may take a further 3–7 business days to appear in your account. We are not responsible for bank processing delays.
- Scope: This guarantee applies to your first subscription charge only. It does not apply to subsequent renewals, upgrades, or re-subscriptions after a previous refund has been issued.
- Outside the guarantee window: Refunds outside the 30-day window are at our sole discretion. We may decline refund requests if there is evidence of material use of the Service (e.g., extensive AI Workflow usage) during the billing period.
- Billing errors: If you believe a charge was made in error (e.g., charged after cancellation), contact us immediately. We will investigate and correct genuine errors regardless of the 30-day window.
- Stripe’s standard processing fees may be non-refundable in some jurisdictions. In that case, your refund will be the subscription amount net of any non-recoverable fees.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable regulations.
- Attempt to scrape, crawl, or systematically extract data from the Service.
- Reverse-engineer, decompile, or attempt to extract source code.
- Resell, sublicense, or commercially redistribute content from the Service without written permission.
- Use the Service to manipulate markets, spread misinformation, or engage in market abuse.
- Circumvent any access controls, rate limits, or subscription restrictions.
- Upload or transmit malware, spam, or harmful content.
- Use AI-generated outputs from the Service (including AI Workflow drafts) as the basis for regulated financial advice provided to third parties.
8. No Financial Advice — Important Disclaimer
All content on the Service — including Signal Scores, signal rankings, AI-generated summaries, impact assessments, “Why it Matters” explanations, Emerging Narratives, Catalysts, Watchlist alerts, and AI Workflow drafts — is for informational and research purposes only. None of it constitutes financial, investment, legal, tax, or trading advice, and none of it is a solicitation or recommendation to buy, sell, or hold any security, asset, or financial instrument.
You should not make any financial decision based solely or primarily on information from the Service. Always conduct your own independent research and consult a qualified, licensed financial adviser before making investment decisions.
Past signal accuracy, Signal Score performance, and narrative outcomes do not guarantee future results. Markets are inherently uncertain. Whisper Media accepts no responsibility for financial losses incurred as a result of using information from the Service.
The Signal Score is an algorithmic relevance ranking. It does not predict price movements, trading volume, or investment returns. A “CRITICAL” signal is not a buy or sell signal.
9. Intellectual Property
The Signal Score algorithm, platform design, and original content produced by Whisper Media are our proprietary intellectual property. News content aggregated from third-party sources remains the property of those sources. You may not reproduce, republish, or redistribute content from the Service without prior written consent.
10. Third-Party Content and Sources
The Service aggregates content from third-party sources including news outlets, social media platforms (Reddit, X/Twitter, YouTube), financial data providers, and regulatory filings. We do not endorse or verify the accuracy of third-party content. We are not responsible for any errors, omissions, or outcomes resulting from third-party information.
Social media content sourced from Reddit, X/Twitter, and YouTube may be speculative, misleading, satirical, or factually incorrect. We process this content automatically without human moderation. You acknowledge this risk and agree to treat social-sourced signals with appropriate scepticism.
11. Copyright and DMCA Takedown Notices
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (“DMCA”). If you believe that content appearing on the Service infringes your copyright, please send a written notice to our designated agent:

Your notice must include all of the following:
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material on the Service and its location (URL or description) sufficient for us to locate it;
- Your contact information (name, address, telephone number, and email address);
- A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner; and
- Your physical or electronic signature.
We will respond to valid DMCA notices promptly and, where appropriate, remove or disable access to the claimed material. We will notify the person who posted the material of the takedown where reasonably practicable. Accounts of repeat infringers may be terminated.
Counter-notice:If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to the same address. Your counter-notice must meet the requirements of 17 U.S.C. § 512(g)(3). Upon receipt of a valid counter-notice we will restore the removed material within 10–14 business days unless the original complainant seeks a court order to restrain the restoration.
Note that because we aggregate publicly available third-party content automatically, we cannot guarantee that all aggregated material is free of copyright claims. We act expeditiously upon receiving a valid notice.
12. AI-Generated Content and Accuracy Limitations
Whisper Media uses large language model AI (Claude by Anthropic) to process, rewrite, and classify content. You acknowledge the following limitations:
- Headlines and summaries are AI rewrites. They may contain errors, omissions, or inaccuracies compared to the original source. Always check the original source before acting on any signal.
- Classifications may be incorrect. Category labels, priority levels (Critical / High / Medium / Low), and directional signals (Bullish / Bearish / Neutral) are assigned automatically and are not human-reviewed.
- Signal scoring is not predictive. The Signal Score reflects recency, source credibility, and cross-platform presence. It has no proven correlation with future price action.
- AI Workflow outputs are research drafts. They must be reviewed by a qualified human before any use. They are not verified facts, actionable advice, or publishable research.
- AI can hallucinate. AI-generated text may contain invented facts, incorrect figures, or false attributions. Do not rely on AI outputs without independent verification.
- Coverage is limited and may be unrepresentative. We do not cover all financial media. Absence of a signal does not mean absence of an event.
13. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
To the maximum extent permitted by applicable law, Whisper Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or investment returns;
- Financial losses arising from trading or investment decisions made using the Service;
- Loss of data or business interruption;
- Inaccurate, delayed, or missing signals;
- Downtime caused by third-party infrastructure failures or force majeure events;
- Unavailability of beta features or features marked “coming soon”;
- Errors in AI-generated content, including hallucinations or misclassifications;
- Actions taken based on social media content processed by the Service;
- Copyright claims arising from third-party content aggregated by the Service.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amounts you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Whisper Media and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any applicable law or regulation.
15. Termination
We may suspend or terminate your account at any time for violation of these Terms, for fraudulent or abusive conduct, or for any other reason at our discretion, with or without prior notice. You may delete your account at any time from your Settings page. Upon termination, your right to use the Service ceases immediately. Paid subscription access will remain until the end of the current billing period unless terminated for cause.
16. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by events beyond our reasonable control (“Force Majeure Event”), including but not limited to:
- Acts of God, natural disasters, fire, flood, earthquake, storm, or other natural events;
- Pandemic, epidemic, or public health emergency;
- War, terrorism, riot, civil unrest, or government action;
- Regulatory action, sanctions, or changes in law that prevent or restrict the Service;
- Failure or disruption of internet infrastructure, power grids, or telecommunications networks outside our control;
- Cyberattacks, denial-of-service attacks, or malicious interference with our systems or those of our infrastructure providers;
- Failure, outage, or degraded performance of third-party services we depend on, including cloud infrastructure providers, payment processors, data providers, and AI model providers; or
- Any other cause genuinely beyond our reasonable control.
We will use commercially reasonable efforts to mitigate the effects of a Force Majeure Event, to communicate the situation to affected users where practicable, and to restore normal Service operation as soon as reasonably possible. We are not obligated to provide refunds or credits for periods of unavailability caused by a Force Majeure Event, except where required by applicable consumer protection law.
If a Force Majeure Event prevents us from providing the Service for a continuous period exceeding 30 days, either party may terminate the affected subscription by giving written notice. In that case, we will refund any prepaid amounts for the unused portion of the subscription period.
17. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email and with an in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not accept the changes, you must stop using the Service and may request a pro-rated refund of any unused prepaid subscription.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes that cannot be resolved amicably shall be referred to the competent courts of that jurisdiction.
If you are an EU or UK consumer, you retain the right to bring proceedings in your country of residence and the right to access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
